AND UPON the Order of Justice Robert French dated 27 September 2023 dismissing the Application for Interim Relief and awarding costs to the Defendant (“Order”)
AND UPON the Defendant filing a Notice of Commencement and Bill of Costs on 8 January 2024
AND UPON the Claimant and the Defendant having agreed a settlement of the costs awarded to the Defendant in the Order
IT IS HEREBY CONSENTED THAT:
1. The costs assessment proceedings commenced by the Defendant are discontinued.
2. There is no order as to costs.
