CONSENT ORDER
UPON the Judgement of Justice Lord Angus Glennie dated 7 September 2023 as amended by way of an Amended Judgment dated 28 September 2023
AND UPON the Claimants’ Application No. CFI-105-2021/4 dated 13 May 20214 seeking an order that the Defendants pay the Claimants’ costs on of the proceedings on a standard basis and a payment on account (the “Costs Application”)
AND UPON the Defendants’ evidence in answer to the Costs Application dated 28 June 2024
AND UPON The claimants’ evidence in reply to the Costs Application dated 19 July 2024
AND UPON the Defendants’ Application No. CFI-105-2021/5 dated 5 July 20214 seeking an extension of time to file their evidence in answer to the Costs Application (the “EOT Application”)
AND UPON the parties agreeing to the terms of this Consent Order to enable the parties to use their best endeavours to reach settlement in respect of the Costs Application
IT IS HEREBY ORDERED BY CONSENT THAT:
1. All further steps in the proceedings to be stayed until 14 October 2024 when this stay shall be automatically lifted.
2. Parties shall have liberty to apply to extend this stay by consent.
3. Parties shall have liberty to apply to lift this stay at any time by letter to the Court explaining the status of the parties’ settlement endeavours.
4. The costs of this Consent Order are to be costs in the Costs Application.
